Madigan Sues Online Retailer for Fraud, Deceptive Business Practices
According to a press release dated March 17, 2015, Illinois Attorney General Lisa Madigan announced lawsuit against Great Sports, Inc., Legion Global Corp. and Gary M. Briden, president of both companies. The lawsuit alleges that consumers purchasing goods at any of the company's websites, www.greaterpowersports.com, www.globaltrailer.net, and www.saferwholesale.com, received incorrect orders and damaged products. The lawsuit further alleges that upon contacting the company, consumers were denied refunds and offered store credit or warranties instead. When attempting to return items, the lawsuit alleges consumers were charged shipping costs and up to 30% in restocking fees.
The lawsuit finds that Briden advertised and sold items through several eBay accounts on behalf of the two companies, at least 7 of which were suspended for violating eBay's terms of service.
Madigan is requesting the courts to prevent the company from doing business in Illinois, and is seeking to revoke the company's license, provide restitution to consumers, and impose civil penalties on the defendants.
PATTERN OF COMPLAINT
A recent review of consumer complaints filed with the BBB of Chicago and Northern Illinois against the company delineates a pattern of consumer allegations. In their complaints, consumers allege the following:
Consumers placed an order and after making payment were told that items were not in stock and a refund was not applied. In addition, they were informed that it could take up to a month to receive the product.
Customers tried to replace defective parts per their warranty and the request was either not honored at all or incorrect/incomplete parts were sent.
Consumers ordered items online and did not receive the correct product or the product arrived and was of poor quality/not as advertised on the company website.
